By engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree with any part of these Terms & Conditions, we kindly ask that you refrain from using our services.
1.2 These Terms & Conditions shall be governed by and construed under the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in California
2.1 CabinCraftMedia specializes in delivering high-quality marketing solutions designed to help home improvement businesses grow. Our primary services include:
Quality Lead Generation - Development of targeted campaigns to attract, engage, and convert high-quality prospects who are most likely to become paying customers.
Omni-Channel Advertising - Strategic planning and management of advertising campaigns across multiple digital platforms, ensuring consistent brand visibility, cohesive messaging, and maximized return on investment.
Marketing Strategy Consultation - A comprehensive, data-driven analysis and planning session designed to identify your target audience, assess market opportunities, and develop a tailored strategy for sustainable growth. This service includes evaluating your current positioning, competitive landscape, and marketing channels to create an actionable plan that maximizes brand visibility, lead quality, and return on investment.
2.2 All services are delivered in accordance with industry best practices and tailored to meet the specific goals outlined in each client’s agreement. CabinCraftMedia reserves the right to adapt or refine service offerings as necessary to maintain performance and quality standards. Except as expressly guaranteed herein, CabinCraftMedia does not warrant specific results, revenue, or sales.
By using our services, you confirm that:
Are at least 18 years old.
Have the authority to enter into this agreement on behalf of your business.
Will provide accurate and complete information.
4.1 All service fees are listed in your Service Agreement or Proposal. Fees may change in the future, but no new rates will apply without your written approval.
4.2 You agree to provide valid payment information (credit/debit card or PayPal) and authorize us to charge this method automatically for recurring monthly fees, unless otherwise stated in writing.
4.3 Payments are billed in advance on a recurring monthly basis, beginning on the date of your initial payment. All invoices are due immediately upon receipt unless otherwise agreed.
4.4 Except as provided under the 30-Day Lead Guarantee (Section 5.2), all payments to CabinCraftMedia are non-refundable and due regardless of marketing performance. After the initial 30-day guarantee period, Client acknowledges that advertising outcomes may vary and agrees that payment is owed for management, strategy, and implementation services, regardless of lead volume.
5.1 You may cancel within 14 days of your first payment and receive a refund of all CabinCraftMedia service fees paid, less any third-party advertising costs already spent on your behalf.
5.2 If the Company does not deliver the guaranteed five (5) qualified leads within thirty (30) days, the Client will be entitled to a full refund of all service fees paid for that (30) day period.
5.3 Advertising spend paid directly to third-party platforms (e.g., Meta/Facebook) is excluded from this refund.
5.4 A "qualified lead" is an individual or business that has expressed genuine interest in the Client’s services and meets the Client’s target criteria, verified through a verifiable contact method such as a form submission, phone call, or email.”
5.5 The guarantee does not apply in cases where failure to deliver results is due to:
Changes in the Client’s business operations
Incorrect or incomplete information provided by the Client
External factors outside the Company’s reasonable control (industry changes, platform restrictions, etc.).
5.6 Refunds under this section shall constitute the Client’s sole and exclusive remedy for the Company’s failure to meet the guaranteed results
5.7 Clients may cancel their agreement at any time by providing at least thirty (30) days’ written notice to CabinCraftMedia or an authorized team member. Notice may be submitted via email or other written communication methods accepted by the company.
5.8 Upon receipt of the cancellation notice, services will continue through the end of the 30-day notice period. Clients remain responsible for all service fees and ad spend incurred through the end of that notice period.
6.1 To ensure effective service delivery, the Client agrees to:
Provide all necessary information, access, and approvals in a timely manner.
Respond promptly to Company communications
Maintain accurate and updated business and payment information
6.2 Failure to provide necessary information, approvals, or responses in a timely manner may release the Company from its performance obligations, including lead guarantees.
8.1 To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages, including lost profits, lost business opportunities, or reputational harm, arising from the use or inability to use our services. The Client acknowledges that results may vary and agrees that the Company’s total liability shall not exceed the fees paid for the services under this Agreement.
8.2 Nothing in this Agreement shall limit liability for gross negligence, willful misconduct, or violations of law
9.1 All creative assets, advertising materials, and marketing strategies developed by the Company remain the property of the Company unless otherwise agreed in writing. Upon full payment of fees, the Client is granted a limited, non-exclusive, non-transferable license to use such materials solely for their business purposes.
9.2 All advertising accounts, platforms, and data remain property of the Company unless otherwise agreed. Client materials provided to the Company remain the Client’s property
10.1 The Company reserves the right to update or amend these Terms and Conditions at any time. Clients will be notified of material changes, and continued use of services constitutes acceptance of the updated Terms.
10.2 Amendments will not affect services already contracted or paid for unless mutually agreed
The Client agrees to indemnify, defend, and hold harmless CabinCraftMedia, its employees, and affiliates from any claims, damages, liabilities, or expenses arising out of the Client’s business practices, use of services, or violation of these Terms
The Company may suspend or terminate services immediately if the Client breaches these Terms, engages in unlawful activity, or fails to make timely payment
This Agreement constitutes the entire and exclusive understanding between the parties and supersedes all prior or contemporaneous agreements, representations, negotiations, or communications, whether written or oral. No amendment, modification, or waiver of any provision of this Agreement shall be valid unless made in writing and signed by both parties
